14and this product shall be multiplied by the equalization index to determine state
15aids. In this subdivision paragraph, the “applicable percentage" is the percentage
16sufficient to generate total aid under this section that will fall within the range of
170.999 and 1.001 of 70 percent of the amount appropriated under s. 20.292 (1) (d), as
18determined by the board.

AB64,395,923 38.28 (2m) (e) Approval; modification. No later than March 31, 2014 2018, the
24board shall submit a plan for making allocations pursuant to the formula established
25under subd. 1. pars. (a) to (d) to the joint committee on finance. If the cochairpersons

1of the joint committee on finance do not notify the board within 14 working days after
2the date of the submittal of the plan that the committee has scheduled a meeting to
3review the plan, the board shall implement the plan. If, within 14 working days after
4the date of the submittal of the plan, the cochairpersons of the committee notify the
5board that the committee has scheduled a meeting to review the plan, the secretary
6of administration. The board may not implement the plan unless the committee
7secretary of administration approves or modifies the plan. If the committee
8secretary of administration modifies the plan, the board may implement the plan
9only as modified by the committee secretary.

AB64,395,1612 38.28 (2m) (f) 1. (intro.) In each fiscal year, beginning in fiscal year 2014-15
132018-19, the board shall submit a report to the joint committee on finance secretary
14of administration that describes how the amount appropriated under s. 20.292 (1) (d)

AB64,396,53 38.28 (2m) (f) 2. The board shall make the report submitted under subd. 3. 1.
4available to the public. Each district board that maintains an Internet site shall
5make the report available to the public at the Internet site.

AB64,396,128 38.28 (2m) (g) Legislative proposals. The board shall include in its biennial
9budget request under s. 16.42 any legislative proposals that the board recommends
10that relate to the criteria specified in subd. 1. a. to i. pars. (a) to (d) or to the plan or
11formula approved or modified by the joint committee on finance secretary of
12administration under subd. 2. par. (e).

138.28 (3) (b) Minimum standards; violations; necessity. Notwithstanding pars.
2(b), (be), and (bm) subs. (2) and (2m), the board may withhold, suspend or reduce in
3whole or in part payment of state aid under this subsection sub. (2) or (2m) to any
4district board whose program or educational personnel does not meet minimum
5standards set by the board or which violates this chapter or any rule promulgated
6by the board under the authority of this chapter. The board shall discontinue aids
7to those programs which are no longer necessary to meet needs within the state.

AB64,397,1611 38.28 (2m) Performance funding. (a) Affordability and attainability. The
12board shall rank each district board's performance regarding all of the following
13criteria and establish a formula for allocating 10.5 percent of the amount
14appropriated under s. 20.292 (1) (d) for a fiscal year based on a district board's
15ranking for the prior fiscal year so that a district board receives an allocation that
16is greater than any other district board with a lower ranking:

AB64,398,66 4. The workforce training provided to businesses and individuals.

AB64,398,127 (c) Student success in state workforce. The board shall rank each district
8board's performance regarding all of the following criteria and establish a formula
9for allocating 6 percent of the amount appropriated under s. 20.292 (1) (d) for a fiscal
10year based on a district board's ranking for the prior fiscal year so that a district
11board receives an allocation that is greater than any other district board with a lower
12ranking:

14school or English language learning courses, or courses that combine basic skills and
15occupational training as a means of expediting basic skills remediation, and the
16success rate of adult students completing such courses.

AB64,398,1918 3. Training or other services provided to special populations or demographic
19groups that can be considered unique to the district.

AB64,398,2520 (d) Efficiency. The board shall rank each district board's performance
21regarding participation in statewide or regional collaboration or efficiency initiatives
22and establish a formula for allocating 3 percent of the amount appropriated under
23s. 20.292 (1) (d) for a fiscal year based a district board's ranking for the prior fiscal
24year so that a district board receives an allocation that is greater than any other
25district board with a lower ranking.

AB64,399,1911 38.28 (3) (d) Sick leave. State aid shall not be paid to a district for any year,
12unless every teacher, administrator, principal and supervisor employed by the
13district during that year is under a contract providing for leave of absence by reason
14of sickness of such person, without deduction from salary, for not less than 5 days per
15year and for accumulation of unused sick leave from year to year to a total of not less
16than 30 days. No allowance may be paid for such absences from teaching or other
17educational services rendered in evening school by any person employed at least 30
18hours per week in day school. This subsection paragraph does not apply to a person
19employed by the district board for less than 30 hours per week.

AB64,399,2121 38.28 (6) (title) Anticipated costs.

AB64,400,65 440.52 (1) (e) 8. Schools accredited by accrediting agencies recognized by the
6board department.

AB64,400,1110 440.52 (1) (g) “Teaching location" means the area and facilities designated for
11use by a school required to be approved by the board department under this section.

AB64,400,2014 440.52 (2) Responsibilities. The board department shall protect the general
15public by inspecting and approving private trade, correspondence, business, and
16technical schools doing business within this state, whether located within or outside
17this state, changes of ownership or control of the schools, teaching locations used by
18the schools, and courses of instruction offered by the schools and regulate the
19soliciting of students for correspondence or classroom courses and courses of
20instruction offered by the schools.

AB64,400,2423 440.52 (3) Rule-making power. The board department shall promulgate rules
24and establish standards necessary to administer this section.

AB64,401,73 440.52 (7) Approval of schools generally. (intro.) To protect students,
4prevent fraud and misrepresentation in the sale and advertising of courses and
5courses of instruction, and encourage schools to maintain courses and courses of
6instruction consistent in quality, content, and length with generally accepted
7educational standards, the board department shall do all of the following:

17control of schools, and teaching locations meeting the requirements and standards
18established by the board department and complying with rules promulgated by the
19board department; publish a list of the schools and courses of instruction approved

21“state," or “Wisconsin" in their names; and make those lists of the schools available
22on the board's department's Internet site.

1440.52 (7) (h) Issue permits to solicitors when all board department
2requirements have been met.

AB64,402,65 440.52 (7) (i) Require schools to furnish a surety bond in an amount as provided
6by rule of the board department.

AB64,402,159 440.52 (8) (a) In general. No solicitor representing any school offering any
10course or course of instruction shall sell any course or course of instruction or solicit
11students for a course or course of instruction in this state for a consideration or
12remuneration, except upon the actual business premises of the school, unless the
13solicitor first secures a solicitor's permit from the board department. If the solicitor
14represents more than one school, a separate permit shall be obtained for each school
15the solicitor represents.

AB64,403,1516 (b) Solicitor's permit. The application for a solicitor's permit shall be made on
17a form furnished by the board department and shall be accompanied by a fee and a
18surety bond acceptable to the board department in the sum of $2,000. The board
19department shall, by rule, specify the amount of the fee for a solicitor's permit. The
20bond may be continuous and shall be conditioned to provide indemnification to any
21student suffering loss as the result of any fraud or misrepresentation used in
22procuring his or her enrollment or as a result of the failure of the school to perform
23faithfully the agreement the solicitor made with the student, and may be supplied
24by the solicitor or by the school itself either as a blanket bond covering each of its
25solicitors in the amount of $2,000 or the surety bond under sub. (7) (i). Upon approval

1of a permit, the board department shall issue an identification card to the solicitor
2giving his or her name and address, the name and address of the employing school,
3and certifying that the person whose name appears on the card is authorized to solicit
4students for the school. A permit shall be valid for one year from the date issued.
5Liability under this paragraph of the surety on the bond for each solicitor covered by
6the bond shall not exceed the sum of $2,000 as an aggregate for any and all students
7for all breaches of the conditions of the bond. The surety of a bond may cancel the
8bond upon giving 30 days' notice in writing to the board department and shall be
9relieved of liability under this paragraph upon giving the notice for any breach of
10condition occurring after the effective date of the cancellation. An application for
11renewal shall be accompanied by a fee, a surety bond acceptable to the board
12department in the sum of $2,000 if a continuous bond has not been furnished, and
13such information as the board department requests of the applicant. The board
14department shall, by rule, specify the amount of the fee for renewal of a solicitor's
15permit.

AB64,403,1816 (c) Refusal or revocation of permit. (intro.) The board department may refuse
17to issue or renew, or may revoke, any solicitor's permit upon one or any combination
18of the following grounds:

20department under this section.

AB64,403,2221 2. Furnishing false, misleading, or incomplete information to the board
22department.

AB64,403,2423 4. Refusal by the school to be represented to allow reasonable inspection or to
24supply information after written request therefor by the board department.

15. Failure of the school which the solicitor represents to meet requirements and
2standards established by and to comply with rules promulgated by the board
3department under sub. (7).

AB64,404,84 (d) Notice of refusal to issue or renew permit. Notice of refusal to issue or renew
5a permit or of the revocation of a permit shall be sent by registered mail to the last
6address of the applicant or permit holder shown in the records of the board
7department. Revocation of a permit shall be effective 10 days after the notice of
8revocation has been mailed to the permit holder.
