This rule makes the following changes to Wisconsin's administrative rules relating to minimum wage rates:
The rule defines an “opportunity employe” as an employe who is under 20 years of age and in his or her first 90 days of employment with each new employer. The minimum wage for an opportunity employe is $4.25 per hour. This provision is similar to the provision on probationary employes in the federal Fair Labor Standards Act.
The rule provides that an employer may not displace an employe solely for the purpose of hiring an employe to be paid the opportunity wage.

This proposed rule changes the minimum wage rates paid by any business with employes who receive the minimum wage, but it does not impose any new requirements upon employers.

Notice is given that pursuant to ss. 103.005 (1), 103.02 and 104.04, Stats., the Department of Workforce Development proposes to hold a public hearing to consider the creation of s. DWD 272.14, Wis. Adm. Code, relating to minimum wage--displacement.

This rule adds a provision to the rules relating to the minimum wage to provide that an employer may not displace an employe solely for the purpose of hiring an employe to be paid the opportunity wage. (The opportunity wage rate, $4.25 per hour, may be paid to an employe who is under 20 years of age and in his or her first 90 days of employment with each new employer.)

SECTION 1. DWD 272.14 is created to read:
DWD 272.14 Prohibition of displacement. An employer may not displace an employe solely for the purpose of hiring an employe to be paid the opportunity wage.
