AB859,1,2 1An Act to create 29.318 of the statutes; relating to: prohibiting the hunting of
2mourning doves and requiring a referendum.

Under rules promulgated by the department of natural resources (DNR), there
is an open season for the hunting of mourning doves.
This bill prohibits DNR from authorizing an open season for the hunting of
mourning doves and imposes a specific ban against the hunting of these doves.
The bill, however, does not take effect until there is submitted to the vote of the
electors at the general election in November 2002 the question "Shall section 1 of
2001 Wisconsin Act .... (this act), which prohibits the hunting of mourning doves,
become law effective January 1, 2003?," and the question is approved by a majority
of all votes cast on the question at the election.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB859, s. 1 3Section 1 . 29.318 of the statutes is created to read:

129.318 Hunting doves. (1) Notwithstanding s. 29.001 (42), in this section
2"hunt" means to shoot, shoot at, take, capture, or kill, or pursue for the purpose of
3shooting, shooting at, taking, capturing, or killing.
AB859,2,5 4(2) The department may not establish or authorize an open season for the
5hunting of mourning doves and no person may hunt mourning doves at any time.
AB859, s. 2 6Section 2 . Nonstatutory provisions.
AB859,2,127 (1) Referendum. There shall be submitted to the vote of the electors at the
8general election in November 2002 the following question: "Shall section 1 of 2001
9Wisconsin Act .... (this act), which prohibits the hunting of mourning doves, become
10law effective January 1, 2003?." If the question is approved by a majority of all votes
11cast on the question at the election, Section 1 of this act shall become law; otherwise,
12Section 1 of this act shall not take effect.
AB859, s. 3 13Section 3. Effective dates. This act takes effect on the day after publication,
14except as follows:
AB859,2,1615 (1) The treatment of section 29.318 of the statutes takes effect on January 1,
162003, if the condition set forth in Section 2 (1 ) of this act is satisfied.
