AB701,1,2 1An Act to amend 287.23 (3) (b); and to create 287.07 (1m) (c) of the statutes;
2relating to: a ban on disposal and incineration of used automotive oil filters.
Analysis by the Legislative Reference Bureau
Current law prohibits the disposal of waste oil in a solid waste disposal facility
and the burning of waste oil without energy recovery in a solid waste treatment
facility. Used automotive oil filters that are not lead-plated may be disposed of in
a solid waste disposal facility or burned without energy recovery in a solid waste
treatment facility, if the oil filter is first properly drained of waste oil. Current law
requires each city, village, town, county or other governmental unit responsible for
a region's solid waste management ("responsible unit") to develop and implement a
recycling or other program to comply with state bans on disposal of specified
materials in a solid waste disposal facility.
Beginning on January 1, 2000, this bill prohibits the disposal of used
automotive oil filters in a solid waste disposal facility and the burning of a used
automotive oil filter without energy recovery in a solid waste treatment facility.
When the prohibition takes effect each responsible unit is required to develop and
implement a recycling or other program to comply with the disposal ban created by
this bill. The bill makes the costs of complying with this prohibition eligible for this
state's annual recycling grants to responsible units.
A person who disposes of or burns a used automotive oil filter on or after
January 1, 2000, in violation of this ban may be required to forfeit not more than $50

for a first violation, $200 for a 2nd violation or $2,000 for a 3rd or a subsequent
violation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB701, s. 1 1Section 1. 287.07 (1m) (c) of the statutes is created to read:
AB701,2,52 287.07 (1m) (c) Beginning on January 1, 2000, dispose of an oil filter used in
3a motor vehicle, as defined in s. 287.15 (1) (e), in a solid waste disposal facility or burn
4an oil filter used in a motor vehicle, as defined in s. 287.15 (1) (e), without energy
5recovery in a solid waste treatment facility in this state.
AB701, s. 2 6Section 2. 287.23 (3) (b) of the statutes is amended to read:
AB701,2,127 287.23 (3) (b) Only expenses, including capital expenses, anticipated to be
8incurred for planning, constructing or operating a recycling program with one or
9more of the components specified in s. 287.11 (2) (a) to (h) and for complying with the
10prohibition prohibitions under s. 287.07 (1m) (c) and (2) during the year for which
11an application is submitted under sub. (4) are eligible for assistance under the
12program.
