SB330,1,3 1An Act to create 20.435 (1) (ck) and 250.04 (15) of the statutes; relating to:
2providing grants for the purchase of choking rescue devices and making an
3appropriation.
Analysis by the Legislative Reference Bureau
Under this bill, the Department of Health Services makes grants to public,
private, and tribal elementary and secondary schools for purchasing choking rescue
devices. A grant applicant must submit with its application to DHS protocols for the
use of and plans for providing training on the use of the choking rescue devices to be
purchased with the grant. Grant recipients must contribute matching funds equal
to at least 25 percent of the total grant. Additionally, DHS may not award more than
one grant to each recipient.

enact as follows:

SB330,2 1Section 2. 20.435 (1) (ck) of the statutes is created to read:
SB330,2,32 20.435 (1) (ck) Grants for school choking rescue devices. Biennially, the
3amounts in the schedule for grants for choking rescue devices under s. 250.04 (15).
SB330,3 4Section 3. 250.04 (15) of the statutes is created to read:
SB330,2,55 250.04 (15) (a) In this subsection:
SB330,2,66 1. “Governing body” means all of the following:
SB330,2,77 a. A school board of a school district.
SB330,2,88 b. A board or person in charge of a private school.
SB330,2,99 c. A body that controls a tribal school.
SB330,2,1010 d. An operator of a charter school.
SB330,2,1211 2. “School” means an elementary or secondary school that is a public, private,
12or tribal school.
SB330,2,1513 (b) From the appropriation under s. 20.435 (1) (ck), the department shall award
14grants to governing bodies of schools for purchasing choking rescue devices that are
15approved by the department.
SB330,2,1816 (c) Grants under this subsection shall be awarded on a matching basis, under
17which, for each grant awarded, the department shall provide 75 percent, and the
18grantee 25 percent, of the total grant funding.

1(d) An applicant for a grant under this subsection shall, at the time of
2application, submit to the department protocols for the use of and a plan for providing
3training on the use of the choking rescue devices to be purchased with the grant.
SB330,3,54 (e) The department may not award more than one grant to each grantee under
5this subsection.
SB330,3,96 (f) The department may not award a grant under this subsection for the
7purchase of more than 3 choking rescue devices for each school. If more than one
8school is located within the same building, a grant may be awarded for the purchase
9of up to 3 choking rescue devices for each school located within the building.
