AB1058,1,4 1An Act to amend 119.04 (1); and to create 20.255 (2) (dh) and 115.369 of the
2statutes; relating to: school violence prevention and reduction grants,
3providing an exemption from emergency rule procedures, granting
4rule-making authority, and making an appropriation.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Public Instruction to provide grants to
school districts to develop and implement programs to prevent and reduce violence
in schools. Under the bill, DPI will establish, by rule, the eligibility criteria for these
grants and the school violence reduction activities that may be funded with grant
proceeds. The bill further specifies that grant proceeds may not be used to pay school
district personnel costs.

enact as follows:

AB1058,2,32 20.255 (2) (dh) Violence prevention and reduction grants. The amounts in the
3schedule for grants to school districts under s. 115.369.
AB1058,3 4Section 3. 115.369 of the statutes is created to read:
AB1058,2,8 5115.369 Violence prevention and reduction grants. (1) Beginning in the
62018-19 school year, the department shall award grants on a competitive basis to
7school districts to develop and implement programs to prevent and reduce violence
8in schools.
AB1058,2,10 9(2) A school district may not expend proceeds of a grant received under this
10section on school district personnel costs.
AB1058,2,12 11(3) The department shall promulgate rules to implement and administer this
12section, including all of the following:
AB1058,2,1313 (a) Rules that specify eligibility criteria for receiving a grant under this section.
AB1058,2,1514 (b) Rules that specify eligible uses of grant proceeds, including funding any of
15the following school violence prevention activities:
AB1058,2,1716 1. Developing and implementing conflict resolution or dispute management
17strategies, including restorative justice and student leadership programs.
AB1058,2,1918 2. Providing character education, asset building, peer mediation, antibullying,
19and equity programs.

13. Developing and implementing suicide risk screening, intervention, and
2prevention efforts.
AB1058,3,33 4. Implementing behavioral systems of support.

6engagement activities.
AB1058,3,77 7. Providing school threat or risk assessments.

9preparedness, and all-hazards school plans.

1Section 5. Nonstatutory provisions.
AB1058,4,142 (1) Emergency rule making. The department of public instruction may
3promulgate emergency rules under section 227.24 of the statutes to implement
4section 115.369 of the statutes. Notwithstanding section 227.24 (1) (e) 1d. of the
5statutes, the department of public instruction is not required to prepare a statement
6of the scope of the rules required under section 115.369 of the statutes if emergency
7rules are promulgated under this subsection. Notwithstanding section 227.24 (1) (c)
8and (2) of the statutes, emergency rules promulgated under this subsection remain
9in effect until July 1, 2019, or the date on which permanent rules take effect,
10whichever is sooner. Notwithstanding section 227.24 (1) (a) and (3) of the statutes,
11the department is not required to provide evidence that promulgating a rule under
12this subsection as an emergency rule is necessary for the preservation of the public
13peace, health, safety, or welfare and is not required to provide a finding of emergency
14for a rule promulgated under this subsection.
