AB867,1,3 1An Act to renumber and amend 77.707 (1) and 229.67; and to create 77.707
2(1) (b) and 229.67 (2) of the statutes; relating to: prohibiting the inclusion of
3Racine County in the jurisdiction of a local professional baseball park district.
Analysis by the Legislative Reference Bureau
Under current law, the jurisdiction of a local professional baseball park district
is any county with a population of more than 600,000 and all counties that are
contiguous to that county. Under this bill, beginning on the bill's effective date,
Racine County may not be included in the jurisdiction of a local professional baseball
park district.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB867,1 4Section 1. 77.707 (1) of the statutes is renumbered 77.707 (1) (a) and amended
5to read:
AB867,2,66 77.707 (1) (a) Retailers Except as provided in par. (b), retailers and the
7department of revenue may not collect a tax under s. 77.705 for any local professional

1baseball park district created under subch. III of ch. 229 after the last day of the
2calendar quarter that is at least 120 days from the date on which the local
3professional baseball park district board makes a certification to the department of
4revenue under s. 229.685 (2), except that the department of revenue may collect from
5retailers taxes that accrued before the day after the last day of that calendar quarter
6and fees, interest and penalties that relate to those taxes.
AB867,2 7Section 2. 77.707 (1) (b) of the statutes is created to read:
AB867,2,118 77.707 (1) (b) Retailers and the department of revenue may not collect a tax
9under s. 77.705 in Racine County after the day specified under s. 229.67 (2), except
10that the department of revenue may collect from retailers taxes that accrued before
11the day after that date and fees, interest, and penalties that relate to those taxes.
AB867,3 12Section 3. 229.67 of the statutes is renumbered 229.67 (1) and amended to
13read:
AB867,2,2114 229.67 (1) A district's jurisdiction is any county with a population of more than
15600,000 and, except as provided in sub. (2), all counties that are contiguous to that
16county and that are not already included in a different district. Once Except as

created, a district's jurisdiction is fixed even if the
18population of other counties within the district subsequently exceeds 600,000. Once
