AB113,1,2 1An Act to amend 121.91 (7); and to create 121.91 (4) (Lm) of the statutes;
2relating to: a school district revenue limit adjustment for school safety.

Current law generally limits the total amount of revenue per pupil that a school
district may receive from general school aids and property taxes in a school year to
the amount of revenue allowed per pupil in the previous school year. However,
several exceptions to the revenue limit exist under current law. For example, if a
school district increases the services that it provides by adding responsibility for
providing a service transferred to it from another governmental unit, its revenue
limit is increased by the cost of that service.
This bill increases the revenue limit for a school district that develops a school
safety plan with a local law enforcement agency. Under the bill, the amount of the
increase is $100 multiplied by the number of pupils enrolled in the school district or
$40,000, whichever is greater. The school district may use the additional revenue to
purchase school safety equipment, to pay security officers, and for the cost of school
safety measures that are identified in the school district's school safety plan.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 121.91 (4) (Lm) of the statutes is created to read:
AB113,2,62 121.91 (4) (Lm) 1. In this paragraph, "local law enforcement agency" means a
3governmental unit of one or more persons employed full time by a city, town, village,
4or county in this state for the purpose of preventing and detecting crime and
5enforcing state laws or local ordinances and the unit's employees are authorized to
6make arrests for crimes while acting within the scope of their authority.
AB113,2,147 2. The limit otherwise applicable to a school district under sub. (2m) in any
8school year is increased by an amount equal to $100 times the number of pupils
9enrolled in the school district or $40,000, whichever is greater, if the school board
10adopts a resolution to do so, the school board and a local law enforcement agency
11jointly develop a school safety plan that specifies the purposes of the additional
12revenue, the school safety plan is consistent with the school safety plan required
13under s. 118.07 (4), and the school board submits the school safety plan to the
14department.
AB113,2,2015 3. A school district may use the excess revenue under this paragraph to
16purchase school safety equipment, fund the compensation costs of security officers,
17and for school safety expenditures consistent with the school safety plan required
18under s. 118.07 (4). Any additional revenue received by a school district under this
19paragraph is not included in the base for determining the school district's limit under
20sub. (2m) for the following school year.
AB113,2 21Section 2. 121.91 (7) of the statutes is amended to read:
AB113,3,322 121.91 (7) Except as provided in sub. (4) (f) 2., (Lm), (o), and (q) and (8), if an
23excess revenue is approved under sub. (3) for a recurring purpose or allowed under
24sub. (4), the excess revenue shall be included in the base for determining the limit
25for the next school year for purposes of this section. If an excess revenue is approved

1under sub. (3) for a nonrecurring purpose, the excess revenue shall not be included
2in the base for determining the limit for the next school year for purposes of this
3section.
AB113,3 4Section 3. Initial applicability.
AB113,3,65 (1) This act first applies to the calculation of a school district's revenue limit
6for the school year beginning after the effective date of this subsection.
