and
Ziegelbauer, cosponsored by Senators Lasee, Cowles and Grothman.
Referred to Committee on Rural Economic Development and Rural Affairs.
AB95,1,3 1An Act to repeal 125.27 (3) and 125.51 (5) (d) of the statutes; relating to:
2permits issued by the Department of Revenue for the retail sale of alcohol
3beverages.
Analysis by the Legislative Reference Bureau
Under current law, municipalities issue licenses for the retail sale of fermented
malt beverages (beer) and intoxicating liquor. In limited circumstances, the
Department of Revenue (DOR) also issues permits for the retail sale of beer and
intoxicating liquor. Current law, as created in 2009 Wisconsin Act 28, requires DOR,
upon application, to issue retail beer and intoxicating liquor permits to American
Indian tribes meeting certain criteria.
This bill repeals the requirement that DOR issue retail beer and intoxicating
liquor permits to American Indian tribes and specifies that any previously issued
permit is void as of the effective date of the bill.
For further information see the state and local fiscal estimate, which will be
printed as an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB95, s. 1 4Section 1. 125.27 (3) of the statutes is repealed.
AB95, s. 2 5Section 2. 125.51 (5) (d) of the statutes is repealed.
AB95, s. 3
1Section 3. Nonstatutory provisions.
AB95,2,32 (1) Any permit issued under section 125.27 (3) or 125.51 (5) (d), 2009 stats., is
3void as of the effective date of this subsection.
