SB693,1,2 1An Act to amend 350.055 (1) of the statutes; relating to: snowmobile safety
2instruction for persons under 16 years of age.

Under current law, a person who is at least 12 years of age and who is born on
or after January 1, 1985, may not operate a snowmobile unless he or she holds a
snowmobile safety certificate. A snowmobile safety certificate certifies that the
person satisfactorily completed a program administered by the Department of
Natural Resources (DNR) in the safe use of snowmobiles. Instruction under the
program is conducted by instructors certified by DNR. Current law provides that for
each person receiving instruction who is under 16 years of age, the program must
include six hours of classroom instruction. Current law also allows the instructor to
provide up to two additional hours of instruction on a snowmobile.
This bill eliminates the requirement that under the snowmobile safety program
administered by DNR, persons who are under 16 years of age must receive a
minimum number of hours of snowmobile safety instruction in a classroom.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

SB693,2,164 350.055 (1) The department shall establish a program of instruction on
5snowmobile laws, including the intoxicated snowmobiling law, regulations, safety

1and related subjects. The program shall be conducted by instructors certified by the
2department. The department may procure liability insurance coverage for certified
3instructors for work within the scope of their duties under this section. For each
4person who is under the age of 16 years, the program shall include 6 hours of
5classroom instruction, and the instructor may provide to the person up to 2
6additional hours of instruction on a snowmobile as to how it is actually operated.

7Each person satisfactorily completing this program shall receive a snowmobile
8safety certificate from the department. The department shall establish by rule an
9instruction fee for this program. An instructor conducting a program of instruction
10under this section shall collect the instruction fee from each person who receives
11instruction. The department may determine the portion of this fee, which may not
12exceed 50%, that the instructor may retain to defray expenses incurred by the
13instructor in conducting the program. The instructor shall remit the remainder of
14the fee or, if nothing is retained, the entire fee to the department. The department
15shall issue a duplicate certificate of accomplishment to a person who is entitled to a
16duplicate certificate of accomplishment and who pays a fee of $2.75.
