SB630,1,4 1An Act to create 20.435 (2) (km), 20.505 (8) (hm) 25. and 51.606 of the statutes;
2relating to: reimbursement of counties and Indian tribes for unexpected or
3unusually high-cost placement of Indians in mental health treatment facilities
4and making an appropriation.

This bill appropriates $500,000 in Indian gaming receipts to the Department
of Health Services in the 2009-11 fiscal biennium to reimburse tribes and county
departments of human services or social services for unexpected or unusually
high-cost placements of Indian tribe members in a mental health institute.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB630, s. 1 5Section 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
6the following amounts for the purposes indicated: - See PDF for table PDF
SB630, s. 2 1Section 2. 20.435 (2) (km) of the statutes is created to read:
SB630,2,72 20.435 (2) (km) Indian mental health placement. The amounts in the schedule
3to reimburse an Indian tribe or band in this state or a county department as provided
4under s. 51.606 (2). All moneys transferred from the appropriation account under
5s. 20.505 (8) (hm) 25. shall be credited to this appropriation account.
6Notwithstanding s. 20.001 (3) (a), the unencumbered balance on June 30 of each year
7shall revert to the appropriation account under s. 20.505 (8) (hm).
SB630, s. 3 8Section 3. 20.505 (8) (hm) 25. of the statutes is created to read:
SB630,2,109 20.505 (8) (hm) 25. The amount transferred to s. 20.435 (2) (km) shall be the
10amount in the schedule under s. 20.435 (2) (km).
SB630, s. 4 11Section 4. 51.606 of the statutes is created to read:
SB630,2,14 1251.606 Reimbursement for Indian mental health placement. (1) In this
13section, "unusually high-cost" means the amount by which the cost to an Indian tribe
14or to a county department exceeds $50,000.
SB630,2,18 15(2) The department may reimburse from the appropriation account under s.
1620.435 (2) (km) an Indian tribe in this state or a county department for unexpected
17or unusually high-cost placement by a tribal court of a member of the Indian tribe
18or band in a state treatment facility.
