SB494,1,3 1An Act to amend 46.283 (1) (a) 1. of the statutes; relating to: allowing nonprofit
2corporations to operate an aging and disability resource center (suggested as
3remedial legislation by the Department of Health Services).

Currently, an aging and disability resource center provides services to certain
elderly and disabled individuals, including information and referral services related
to long-term care and eligibility screening for the Family Care Program benefit. A
county department or an aging unit that is either an agency of county or tribal
government or a unit within a county department may apply to the Department of
Health Services to operate an aging and disability resource center. This bill allows
aging units that are private, nonprofit corporations to apply to operate an aging and
disability resource center.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Law Revision Committee prefatory note: This bill is a remedial legislation
proposal, requested by the Department of Health Services and introduced by the Law
Revision Committee under s. 13.83 (1) (c) 4. and 5., stats. After careful consideration of
the various provisions of the bill, the Law Revision Committee has determined that this

bill makes minor substantive changes in the statutes, and that these changes are
desirable as a matter of public policy.
SB494, s. 1 1Section 1. 46.283 (1) (a) 1. of the statutes is amended to read:

3s. 46.21, 46.215, 46.22 or 46.23 or an aging unit under s. 46.82 (1) (a) 1. or, 2., or 3.
4to apply to the department for a contract to operate a resource center and, if so, which

Note: Under current law, s. 46.82, stats., allows a private, nonprofit corporation
to be one of the three types of entities to be an aging unit. Section 46.283 (1) (a) 1., stats.,
allows counties to authorize county departments or government-operated aging units to
apply to be an aging and disability resource center under the family care program. This
Section amends s. 46.283 (1) (a) 1. to permit a county to authorize an aging unit that is
a private, nonprofit corporation to be an aging and disability resource center.
