SB441,1,3 1An Act to create 625.36 of the statutes; relating to: reporting and publishing
2factors used to set automobile insurance rates and granting rule-making
3authority.

This bill requires every insurer that issues motor vehicle insurance policies in
this state to report annually to the commissioner of insurance (commissioner) the
factors that the insurer uses to set rates for the coverages under those policies, along
with the relative weight the insurer gives to each factor. The commissioner must
organize the information by insurer and annually publish the organized information
on the Internet Web site of the Office of the Commissioner of Insurance. The
commissioner may charge each insurer that reports information a fee to cover the
commissioner's costs.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB441, s. 1 4Section 1. 625.36 of the statutes is created to read:
SB441,2,5 5625.36 Reporting and publication of factors for setting automobile
6insurance rates.
(1) Reporting requirement. No later than the first day of the 4th

1month beginning after the effective date of this subsection .... [LRB inserts date], and
2then annually thereafter by the anniversary of that date, every insurer that issues
3motor vehicle liability insurance policies in this state shall report to the
4commissioner the factors the insurer uses to set rates for the coverages provided
5under those policies and the relative weight that the insurer gives to each factor.
SB441,2,11 6(2) Publication; fee; rules. The commissioner shall organize the information
7received under sub. (1) and annually, within 3 months after the deadline for
8reporting the information, publish the organized information on the office's Internet
9Web site. The commissioner shall organize the information by insurer and in such
10a manner that persons viewing the Web site are able to make meaningful
11comparisons among insurers. The commissioner may do all of the following:

13commissioner's costs under this section.
SB441,2,1414 (b) Promulgate rules for the administration of this section.
