SB237,1,2 1An Act to amend 100.305 (2) of the statutes; relating to: the governor's
2certification of an abnormal economic disruption.

Under current law, no person may sell consumer goods or services at
unreasonably excessive prices if the governor, by executive order, has certified that
the state or a part of the state is in a period of abnormal economic disruption. Current
law does not specify a procedure for the governor's issuance of an executive order to
trigger the prohibition of unreasonably excessive prices.
This bill specifies that the governor may trigger the prohibition of unreasonably
excessive prices only by issuing an executive order under current provisions that
generally describe the governor's emergency management duties. As a result, under
the bill, the governor may issue such an executive order only upon determining that
an emergency exists as a result of enemy action or natural or man-made disaster.
The duration of the executive order is limited to 60 days if the emergency results from
enemy action, or 30 days if the emergency results from a natural or man-made
disaster, except that the duration may be extended by joint resolution of the
legislature.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
