AB133,1,2 1An Act to create 86.035 of the statutes; relating to: spraying water onto
2highways and providing a penalty.
Analysis by the Legislative Reference Bureau
This bill prohibits a person who owns or occupies land adjoining a highway from
causing water to spray more than two feet onto the roadway of the highway. A person
who violates this prohibition must forfeit $10 for the first offense, $100 for the second
offense, and $1,000 for the third and each subsequent offense.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB133, s. 1 3Section 1. 86.035 of the statutes is created to read:
AB133,1,4 486.035 Water overspray onto highway. (1) In this section:
AB133,1,55 (a) "Highway" has the meaning given in s. 340.01 (22).
AB133,1,66 (b) "Roadway" has the meaning given in s. 340.01 (54).
AB133,1,9 7(2) No person owning or occupying land adjoining any highway may cause
8water to spray from this land onto the roadway of the highway to a distance exceeding
92 feet from the edge of the roadway nearest the person's land.

1(3) Any person who violates sub. (2) shall forfeit $10 for the first offense, $100
2for the second offense, and $1,000 for the third and each subsequent offense.
