1An Act to amend 100.45 (5e) of the statutes;
relating to: regulating substitutes
2for ozone-depleting refrigerants used in mobile air conditioners.

Current law imposes certain restrictions on the sale, installation, and recovery
of ozone-depleting refrigerants used in air conditioners in motor vehicles (mobile air
conditioners). These restrictions currently include: 1) prohibiting the sale of a
container of an ozone-depleting refrigerant in a container that contains less than 15
pounds of the refrigerant; and 2) prohibiting repair of a mobile air conditioner that
may release ozone-depleting refrigerants unless the person performing the repair
holds a registration certificate issued by the Department of Agriculture, Trade and
Consumer Protection (department); pumps any ozone-depleting refrigerant
removed from the mobile air conditioner into storage tanks; and recycles the stored
refrigerant or transfers it to another person for recycling.
Current law also authorizes the department to promulgate rules providing that
the restrictions applicable to ozone-depleting refrigerants also apply with respect to
substances used as substitutes for ozone-depleting refrigerants. This bill prohibits
the department from promulgating or enforcing such rules.
