SB338,1,3 1An Act to amend 120.12 (22) of the statutes; relating to: payment of the costs
2of advanced placement examinations taken by certain pupils (suggested as
3remedial legislation by the Department of Public Instruction).

Current law directs each school board to pay the costs of advanced placement
examinations taken by pupils who are eligible for free or reduced-price lunches
under the federal School Lunch Program. This bill provides that the school board
may use federal, state, local, or private funds to pay these costs.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Law Revision Committee prefatory note: This bill is a remedial legislation
proposal, requested by the Department of Public Instruction and introduced by the Law
Revision Committee under s. 13.83 (1) (c) 1. and 5., as a result of the Revisor of Statutes'
case and opinion review under s. 13.93 (2) (d), stats. After careful consideration of the
various provisions of the bill, the Law Revision Committee has determined that this bill
makes minor substantive changes in the statutes, and that these changes are desirable
as a matter of public policy.

1120.12 (22) Advanced placement examinations. Pay Using federal, state, local,
2or private funds,
the costs of advanced placement examinations taken by pupils
3enrolled in the school district who are eligible for free or reduced-price lunches in the
4federal school lunch program under 42 USC 1758.
Note: Clarifies that local, state, federal, or private funds may be used to pay
advanced placement exam costs for low-income students. According to the Department
of Public Instruction, concern has been expressed by the U.S. Department of Education
that the current provision implies that only state and local funds may be used to pay for
these exams, preventing the award of federal funds. The proposed change has been
recommended by representatives of the college board and the U.S. Department of
Education.
