SB325,1,4 1An Act to amend 49.686 (2) of the statutes; relating to: moneys used to
2reimburse the cost of drugs to treat HIV infections and making appropriations
3(suggested as remedial legislation by the Department of Health and Family
4Services).
Analysis by the Legislative Reference Bureau
Current law provides that the Department of Health and Family Services
(DHFS) may use federal project operations moneys, among other funds, to reimburse
the costs of drugs used to treat persons with an HIV infection. This bill provides that
DHFS may use federal project aids moneys rather than federal project operations
moneys to reimburse these costs.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Law Revision Committee prefatory note: This bill is a remedial legislation
proposal, requested by the Department of Health and Family Services and introduced by
the Law Revision Committee under s. 13.83 (1) (c) 4., stats. After careful consideration
of the various provisions of the bill, the Law Revision Committee has determined that this
bill makes minor substantive changes in the statutes, and that these changes are
desirable as a matter of public policy.

1Section 1. 49.686 (2) of the statutes is amended to read:
SB325,2,52 49.686 (2) Reimbursement. From the appropriations under s. 20.435 (1) (m)
3and (5) (am) and, (i), and (ma), the department may reimburse or supplement the
4reimbursement of the cost of AZT, the drug pentamidine, and any drug approved for
5reimbursement under sub. (4) (c) for an individual who is eligible under sub. (3).
Note: This bill corrects a reference to the federal funding sources for the drug
assistance program that reimburses pharmacies for the cost of certain medications used
in treating human immunodeficiency virus for low-income individuals.
