SB242,1,3 1An Act relating to: eligibility for the public school Open Enrollment Program
2for certain residents of neighboring school districts who wish to attend the
3Auburndale School District.

Currently, under the full-time Open Enrollment Program, a pupil may apply
to attend a public school in a school district other than the pupil's resident school
district if certain conditions are met. The deadline for submitting an application to
the nonresident school district that a pupil wishes to attend is the third Friday
following the first Monday in February in the school year preceding the school year
of attendance.
St. Mary's Catholic School, in Auburndale, Wisconsin, closed at the end of the
2006-07 school year.
This bill allows the parents of a pupil who attended St. Mary's Catholic School
in the 2006-07 school year and who is not a resident of the Auburndale School
District to apply, within five days after the effective date of this bill, to attend a public
school in the Auburndale School District under the Open Enrollment Program.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. Nonstatutory provisions.
SB242,2,72 (1) Open Enrollment Program; extension of application period.
3Notwithstanding section 118.51 (3) of the statutes, the following timeline applies to
4the parent of a pupil who does not reside in the Auburndale School District, who
5attended St. Mary's Catholic School in Auburndale, Wisconsin, in the 2006-07 school
6year, and who wishes to attend a public school in the Auburndale School District in
7the 2007-08 school year under section 118.51 of the statutes:
SB242,2,128 (a) The parent shall submit an application to the school board of the
9Auburndale School District within 5 days after the effective date of this paragraph.
10Upon receipt of the application, the Auburndale school board shall send a copy to the
11school board of the school district in which the pupil resides and the department of
12public instruction.
SB242,2,1413 (b) Not before the 6th day after the effective date of this paragraph, but by the
1412th day after the effective date of this paragraph:
SB242,2,17 151. The Auburndale school board shall notify the applicant whether it has
16accepted the pupil and, if it has accepted the pupil, the specific school or program that
17the pupil may attend in the 2007-08 school year.
SB242,2,20 182. If the school board of the school district in which the pupil resides denies a
19pupil's enrollment in the Auburndale School District, it shall notify the applicant and
20the Auburndale school board.
SB242,2,2321 (c) Within 7 days after receiving notice of acceptance under paragraph (b ) 1.,
22the pupil's parent shall notify the Auburndale school board of the pupil's intent to
23attend school in that school district in the 2007-08 school year.

1(d) By September 1, 2007, the Auburndale school board shall report the names
2of the pupils accepted for attendance in the 2007-08 school year under this
3subsection to the school boards of the school districts in which the pupils reside.
