AB454,1,3 1An Act to amend 20.370 (9) (hu); and to create 29.2297 of the statutes; relating
2to:
issuance by the Department of Natural Resources of federal hunting,
3fishing, and trapping approvals.
Analysis by the Legislative Reference Bureau
Under current law, a person may receive a permit from the federal government
to hunt, fish, or trap within the boundaries of Fort McCoy, a U.S. army installation
in this state (McCoy permit). The McCoy permit is required in addition to a hunting,
fishing, or trapping license issued by the state. Currently, a person must apply in
person at Fort McCoy to receive the permit.
Also under federal law a hunter of migratory waterfowl must have a federal
migratory bird hunting and conservation stamp (duck stamp), in addition to the
state waterfowl hunting stamp issued by the Department of Natural Resources
(DNR).
This bill authorizes the federal government to enter into a contract with DNR
so that McCoy permits and duck stamps may be issued through the automated
statewide system with which DNR contracts for issuing fish and game approvals
(ALIS). The bill requires that the contract set the fees to be collected for McCoy
permits and duck stamps, the amount of each fee to be retained by DNR, and the
amount of each fee to be paid to the ALIS contractor. The bill also authorizes DNR
to contract to issue through ALIS other federal approvals that authorize hunting,
fishing, or trapping.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB454,2,72 20.370 (9) (hu) Handling and other fees. All moneys received by the
3department as specified provided under ss. 23.33 (2) (o), 29.2297, 29.556, 30.52 (1m)
4(e), and 350.12 (3h) (g) for licensing, the issuing of department and federal approvals
5under ch. 29 and
for the issuing and renewing of certificates and registrations by the
6department under ss. 23.33 (2) (i) and (ig), 30.52 (1m) (a) and (ag), and 350.12 (3h)
7(a) and (ag).
AB454, s. 2 8Section 2. 29.2297 of the statutes is created to read:
AB454,2,14 929.2297 Federal approvals for hunting, trapping, and fishing. (1)
10Contract. (a) The department may enter into a contract with the federal
11government under which the department shall issue, through the statewide
12automated system contracted for under s. 29.024 (6) (a) 4., one or more types of
13hunting, fishing, or trapping approvals that are issued or required by the federal
14government.
AB454,2,1515 (b) A contract entered into under par. (a) shall specify all of the following:
AB454,2,1616 1. The total fee to be collected for each approval.
AB454,2,1817 2. The amount of each fee to be retained by the department for each type of
18approval the department issues.
AB454,2,2019 3. Of the amount retained by the department, any amounts to be paid to the
20statewide automated system as issuing and transaction fees.

1(2) Forms. The federal government shall prepare, procure the printing of, and
2supply all necessary forms for applications and approvals issued under this section.
AB454,3,4 3(3) Records. The department shall keep a complete record of all approvals it
4issues under this section.
AB454,3,7 5(4) Use of moneys. All moneys retained by the department pursuant to a
6contract entered into under this section shall be credited to the appropriation
7account under s. 20.370 (9) (hu).
