AB727,1,5 1An Act to repeal 350.12 (5) (c); to amend 350.01 (22), 350.12 (3) (a) 2., 350.12
2(3) (a) 3., 350.12 (3) (d), 350.12 (3h) (ar) 1., 350.12 (5) (b), 350.12 (5) (cm) and
3350.122 (4) (d); and to create 350.12 (5) (bg), 350.12 (5) (br) and 350.12 (5) (cr)
4of the statutes; relating to: the display of registration decals on snowmobiles
5and the possession of registration documentation by operators of snowmobiles.
Analysis by the Legislative Reference Bureau
Under current law, with limited exceptions, no person may operate a
snowmobile unless it is registered with the department of natural resources (DNR),
the person carries the registration certificate, and the registration decals issued by
DNR are displayed on the snowmobile. Under current law, a person may operate a
snowmobile for which an application for registration is pending with DNR without
having the decals displayed on the snowmobile if the person carries the receipt issued
upon submittal of the registration application.
Under the bill, a person may operate a snowmobile for which neither a
registration receipt nor a registration certificate has been issued to the current
owner without having the decals displayed on the snowmobile if the person carries
the original or a copy of the registration certificate delivered to the current owner
upon transfer of ownership. This exemption from displaying the decals is valid for
45 days after the date of transfer of ownership.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB727, s. 1 1Section 1. 350.01 (22) of the statutes, as created by 2001 Wisconsin Act 16, is
2amended to read:
AB727,2,63 350.01 (22) "Validated registration application receipt" means a receipt issued
4by the department or an agent under s. 350.12 (3h) (ag) 1. a. that shows that an
5application and the required fee for a registration certificate has have been
6submitted to the department.
AB727, s. 2 7Section 2. 350.12 (3) (a) 2. of the statutes is amended to read:
AB727,2,168 350.12 (3) (a) 2. Upon For transfer of ownership of a snowmobile for which a
9registration certificate has been issued to the owner, the seller owner shall, at time
10of sale,
on the date of the transfer, sign, date, and deliver the assigned certificate to
11the purchaser person to whom ownership is transferred. For transfer of a
12snowmobile for which a registration certificate has not yet been issued to the owner
13on the date of transfer, the owner shall provide a copy of the certificate to the person
14to whom ownership is transferred, and, upon receipt of the original certificate, shall
15sign, date, and deliver the original certificate to the person to whom the ownership
16is transferred within 10 days after receiving the original certificate
.
AB727, s. 3 17Section 3. 350.12 (3) (a) 3. of the statutes, as affected by 2001 Wisconsin Act

, is amended to read:
AB727,3,319 350.12 (3) (a) 3. The purchaser person to whom ownership of a snowmobile is

shall complete the application for transfer and cause it to be mailed or
21delivered to the department or an agent appointed under sub. (3h) (a) 3. within 10

1days from after the date of purchase on which the person receives the registration
2certificate from the person transferring ownership
. A fee of $5 shall be paid for
3transfer of a current registration certificate.
AB727, s. 4 4Section 4. 350.12 (3) (d) of the statutes, as affected by 2001 Wisconsin Act 16,
5is amended to read:
AB727,3,176 350.12 (3) (d) Upon receipt of the required fee, a sales tax report, payment of
7sales and use taxes due under s. 77.61 (1), and an application on forms prescribed
8by it, the department or an agent appointed under sub. (3h) (a) 3. shall issue to the
9applicant an original registration certificate stating the registration number, the
10name and address of the owner, and other information the department deems
11necessary or a validated registration application receipt. The department or an
12agent appointed under sub. (3h) (a) 3. shall issue 2 registration decals per
13snowmobile owned by an individual owner, this state, or a political subdivision of this
14state. The decals shall be no larger than 3 inches in height and 6 inches in width.
15The decals shall contain reference to the state, the department, whether the
16snowmobile is registered for public use or private use under par. (a), or as an antique
17under par. (b), and shall show the expiration date of the registration.
AB727, s. 5 18Section 5. 350.12 (3h) (ar) 1. of the statutes, as created by 2001 Wisconsin Act
1916
, is amended to read:

21appointed under par. (a) 3. shall collect an expedited service fee of $3 each time the
22agent issues a validated registration application receipt under par. (ag) 1. a. The
23agent shall retain the entire amount of each expedited service fee the agent collects.

6person operating the snowmobile for inspection by any person authorized to enforce
7this section as provided in s. 350.17 (1) and (3)

AB727,4,149 350.12 (5) (bg) For a snowmobile for which the owner has received a validated
10registration application receipt but who has not yet received a registration
11certificate, the validated registration application receipt shall be in the possession
12of the person operating the snowmobile at all times and shall be exhibited, upon
13demand, by the person operating the snowmobile for inspection by any person
14authorized to enforce this section as provided in s. 350.17 (1) and (3).
AB727, s. 8 15Section 8. 350.12 (5) (br) of the statutes is created to read:
