SENATE SUBSTITUTE AMENDMENT 1,
TO SENATE BILL 74

SB74-SSA1,1,3 1An Act to amend 16.75 (3m) (c) 1. and 16.75 (4) (c); and to create 16.75 (3m) (a)
25. and 16.75 (3m) (bm) of the statutes; relating to: state procurement plans for
3amounts paid to small businesses.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB74-SSA1,1 4Section 1. 16.75 (3m) (a) 5. of the statutes is created to read:
SB74-SSA1,1,65 16.75 (3m) (a) 5. "Small business" means a small business as defined by the
6federal small business association.
SB74-SSA1,2 7Section 2. 16.75 (3m) (bm) of the statutes is created to read:
SB74-SSA1,1,118 16.75 (3m) (bm) The department, any agency to which the department
9delegates purchasing authority under s. 16.71 (1), and any agency making purchases
10under s. 16.74 shall develop a plan that at least 10 percent of the total amount
11expended under this subchapter in each fiscal year is paid to small businesses.

1Section 3. 16.75 (3m) (c) 1. of the statutes is amended to read:
SB74-SSA1,2,62 16.75 (3m) (c) 1. After completing any contract under this subchapter, the
3contractor shall report to the agency that awarded the contract any amount of the
4contract that was subcontracted to minority businesses and , any amount of the
5contract that was subcontracted to disabled veteran-owned businesses , and any
6amount of the contract that was subcontracted to small businesses
.
SB74-SSA1,4 7Section 4. 16.75 (4) (c) of the statutes is amended to read:
SB74-SSA1,2,108 16.75 (4) (c) In this section subsection and in s. 16.755, "small business" means
9a business which has had less than $1.5 million in gross annual sales in the most
10recent calendar or fiscal year.
