TO 2011 SENATE BILL 153

SB153-SSA1,1,4 1An Act to amend 40.51 (7) (a) of the statutes; relating to: permitting
2governmental employers who are not participating employers in the Wisconsin
3Retirement System to be covered in the local government health insurance plan
4offered by the group insurance board.
Analysis by the Legislative Reference Bureau
The Group Insurance Board (GIB) offers a health insurance plan to local
government employers and their employees. This substitute amendment
specifically requires the GIB to offer this plan to local government employers who are
not participating employers in the Wisconsin Retirement System.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

140.51 (7) (a) Any employer, other than the state, including an employer that
2is not a participating employer,
may offer to all of its employees a health care
3coverage plan through a program offered by the group insurance board.
4Notwithstanding sub. (2) and ss. 40.05 (4) and 40.52 (1), the department may by rule
5establish different eligibility standards or contribution requirements for such
6employees and employers and may by rule limit the categories of employers, other
7than the state, which may be included as participating employers under this
8subchapter
. Beginning on January 1, 2012, except as otherwise provided in a
9collective bargaining agreement under subch. IV of ch. 111 and except as provided
10in par. (b), an employer may not offer a health care coverage plan to its employees
11under this subsection if the employer pays more than 88 percent of the average
12premium cost of plans offered in any tier with the lowest employee premium cost
13under this subsection.
