AB94-AA2,1,11 At the locations indicated, amend the bill as follows:
AB94-AA2,1,2 21. Page 2, line 1: before that line insert:
AB94-AA2,1,3 3" Section 1d. 119.23 (1) (ag) of the statutes is created to read:
AB94-AA2,1,54 119.23 (1) (ag) "Disqualified person" means an individual who satisfies one of
5the following:
AB94-AA2,1,86 1. Had ownership interest in, or was an officer, director, or trustee of, a private
7school at the time the private school was barred or terminated from participation in
8the program under this section by an order issued under sub. (10).
AB94-AA2,1,129 2. Was the administrator of a private school or identified as an administrator
10designee of the private school at the time the private school was barred or terminated
11from participating in the program under this section by an order issued under sub.
12(10).

13. Was responsible for an action or circumstance that led to the private school
2being barred or terminated from participating in the program under this section by
3an order issued under sub. (10).
AB94-AA2, s. 1h 4Section 1h. 119.23 (2) (a) 7. a. and b. of the statutes are amended to read:
AB94-AA2,2,185 119.23 (2) (a) 7. a. Subject to subd. 7. c. and d., for a private school participating
6in the program under this section on July 1, 2009, the private school achieves
7accreditation by the Wisconsin North Central Association, the Wisconsin Religious
8and Independent Schools Accreditation, the Independent Schools Association of the
9Central States, the Archdiocese of Milwaukee, or any other organization recognized
10by the National Council for Private School Accreditation, by December 31 of the 3rd
11school year following the first school year that begins after June 30, 2006, in which
12it participates in the program under this section, or the private school was approved
13for scholarship funding for the 2005-06 school year by Partners Advancing Values
14in Education. If the private school is accredited as provided under this subd. 7. a.,
15the private school is not required to obtain preaccreditation from the Institute for the
16Transformation of Learning at Marquette University under subd. 7. b. as a
17prerequisite to providing instruction under this section in additional grades or in an
18additional or new school.
AB94-AA2,3,1019 b. Subject to subd. 7. c. and d., for a private school that is a first-time
20participant in the program under this section on or after July 1, 2009, and that is not
21accredited as provided under subd. 7. a., the private school obtains preaccreditation
22from the Institute for the Transformation of Learning at Marquette University by
23August 1 before the first school term of participation in the program under this
24section that begins after July 1, 2009, or by May 1 if the private school begins
25participating in the program during summer school, and achieves accreditation by

1the Wisconsin North Central Association, the Wisconsin Religious and Independent
2Schools Accreditation, the Independent Schools Association of the Central States,
3the Archdiocese of Milwaukee, or any other organization recognized by the National
4Council for Private School Accreditation, by December 31 of the 3rd school year
5following the first school year that begins after July 1, 2009, in which it participates
6in the program under this section. If the private school is accredited under this subd.
77. b., the private school is not required to obtain preaccreditation from the Institute
8for the Transformation of Learning at Marquette University as a prerequisite to
9providing instruction under this section in additional grades or in an additional or
10new school.
AB94-AA2, s. 1p 11Section 1p. 119.23 (2) (a) 7. d. of the statutes is created to read:
AB94-AA2,3,1812 119.23 (2) (a) 7. d. Once a private school seeking accreditation as required
13under this subdivision has commenced the accreditation process with one
14accrediting organization, the private school must complete the accreditation process
15with that accrediting organization and may not transfer its application for
16accreditation to an other accrediting organization. Failure to comply with this subd.
177. d. shall disqualify the private school from participation in the program under this
18section.".

AB94-AA2,4,322 119.23 (10) (a) 8. Retains, whether for compensation or as a volunteer, a
23disqualified person as an owner, officer, director, trustee, administrator, or
24administrator designee, or grants to a disqualified person, whether for compensation

1or as a volunteer, responsibilities over administrative, financial, or pupil health and
2safety matters before the end of a 7-year period beginning on the date of an order
3issued by the state superintendent under this subsection.".
