TO 2011 ASSEMBLY BILL 92

AB92-AA9,1,11 At the locations indicated, amend the bill as follows:

AB92-AA9,1,4 21. Page 2, line 4: delete "the city" and substitute "the city or, subject to par.
3(bm), any pupil in grades 9 to 12 who resides within the city may attend, at no charge,
4any private school located in".

AB92-AA9,1,5 52. Page 3, line 1: after that line insert:

AB92-AA9,1,6 6" Section 4m. 119.23 (2) (bm) of the statutes is created to read:

AB92-AA9,1,107 119.23 (2) (bm) 1. Except as provided in subd. 2., a private school located in
8Milwaukee County may participate in the program under this section only if the
9private school is in operation on the effective date of this subdivision .... [LRB inserts
10date].

AB92-AA9,2,311 2. A private school located in Milwaukee County that will be operated by the
12governing body of a private school that is participating in the program under this
13section on the effective date of this subdivision .... [LRB inserts date], may participate

1in the program under this section but only if all of the following continue to apply for
2the duration of the participation in the program under this section of the private
3school located in Milwaukee County:

AB92-AA9,2,44 a. The governing body of the private school operates a private school in the city.

AB92-AA9,2,75 b. The private school described in subd. 2. a. participates in the program under
6this section and enrolls the same number of pupils in the program under this section
7as the private school enrolled in the 2010-11 school year.".

AB92-AA9,2,8 83. Page 3, line 2: delete lines 2 to 13 and substitute:

AB92-AA9,2,9 9" Section 5m. 119.23 (7) (d) 1. of the statutes is amended to read:

AB92-AA9,2,2310 119.23 (7) (d) 1. A copy of the school's current certificate of occupancy issued
11by the city, if the school building is located in the city, or, for a school building located
12in Milwaukee County, evidence satisfactory to the department that the school
13building is in compliance with all applicable state and local laws, rules, codes, and
14ordinances. If the private school moves to a new location in the city, the private school
15shall submit a copy of the new certificate of occupancy issued by the city to the
16department before the attendance of pupils at the new location and before the next
17succeeding date specified in s. 121.05 (1) (a). If the private school moves to a new
18location in Milwaukee County, the private school shall submit evidence satisfactory
19to the department that the school building in the new location is in compliance with
20all applicable state and local laws, rules, codes, and ordinances before the attendance
21of pupils at the new location and before the next succeeding date specified in s. 121.05
22(1) (a). A temporary certificate of occupancy does not meet the requirement of this
23subdivision.".
