18employes on a full-time basis.

AB150-ASA1-AA26,326,2520 234.82 (4) (a) The borrower uses the loan proceeds for upgrading, renovating
21or expanding an eligible business under sub. (1) (a) 1. or for start-up costs for an
22eligible business under sub. (1) (a) 2. Loan proceeds may be used for direct or related
23expenses associated with the purchase or improvement of land, buildings,
24machinery, equipment or inventory. Loan proceeds may not be used to refinance
25existing debt or for operating or entertainment expenses.".

AB150-ASA1-AA26,327,5 3234.84 Job training loan guarantee program. (1) Guarantee
4requirements. The authority may use money from the Wisconsin development
5reserve fund to guarantee a loan under this section if all of the following apply:

AB150-ASA1-AA26,327,77 (b) The loan qualifies as an eligible loan under sub. (2).

AB150-ASA1-AA26,327,98 (c) The lender is a financial institution that enters into an agreement under s.
9234.93 (2) (a).

AB150-ASA1-AA26,327,11 10(2) Eligible loans. A loan is eligible for guarantee of collection from the
11Wisconsin development reserve fund under s. 234.93 if all of the following apply:

AB150-ASA1-AA26,327,1412 (a) The borrower uses the loan proceeds for expenses related to employe
13training or retraining or for purchasing equipment or upgrading facilities for
14purposes related to employe training or retraining.

AB150-ASA1-AA26,327,1615 (b) Loan proceeds are not used to refinance existing debt or for operating or
16entertainment expenses.

AB150-ASA1-AA26,327,1817 (c) The interest rate on the loan, including any origination fees or other charges,
18is approved by the authority.

AB150-ASA1-AA26,327,2119 (d) The loan term does not extend beyond 3 years if the loan proceeds are used
20exclusively for expenses related to instruction or training, or beyond 5 years if the
21loan proceeds are used for purchasing equipment or upgrading facilities.

AB150-ASA1-AA26,327,2322 (e) The total principal amount of all loans to the borrower that are guaranteed
23under this section does not exceed $250,000.

1(f) The financial institution obtains a security interest in the physical plant,
2equipment or other assets if the loan proceeds are used for purchasing equipment or
3upgrading facilities.

AB150-ASA1-AA26,328,54 (g) The financial institution believes that it is reasonably likely that the
5borrower will be able to repay the loan in full with interest.

AB150-ASA1-AA26,328,76 (h) The financial institution agrees to the percentage of guarantee established
7for the loan by the authority.

AB150-ASA1-AA26,328,14 8(3) Guarantee of collection. (a) Subject to par. (b), the authority shall
9guarantee collection of a percentage of the principal of any loan eligible for a
10guarantee under sub. (1). The authority shall establish the percentage of the
11principal of an eligible loan that will be guaranteed, using the procedures described
12in the agreement under s. 234.93 (2) (a). The authority may establish a single
13percentage for all guaranteed loans or establish different percentages for eligible
14loans on an individual basis.

AB150-ASA1-AA26,328,1715 (b) Except as provided in s. 234.93 (3), the total outstanding guaranteed
16principal amount of all loans that the authority may guarantee under par. (a) may
17not exceed $14,000,000.".

AB150-ASA1-AA26,328,2420 252.12 (2) (c) HIV prevention grants. From the appropriation under s. 20.435
21(7) (md), the department shall award to applying nonprofit corporations or public
22agencies up to $75,000 in each fiscal year, on a competitive basis, as grants for
23services to prevent HIV. Criteria for award of the grants shall include all of the
24following:

2and numbers of persons proposed to be served.

9agency staff and services.

AB150-ASA1-AA26,329,1110 5. The proposed method by which the applicant would evaluate the impact of
11the grant funds awarded.".

AB150-ASA1-AA26,330,216 301.03 (3) Administer parole and, probation and community supervision
17matters, except that the decision to grant or deny parole to inmates shall be made
18by the parole commission and the decision to revoke probation or parole in cases in
19which there is no waiver of the right to a hearing shall be made by the division of
20hearings and appeals in the department of administration. The secretary may grant
21special action parole releases under s. 304.02. The department shall promulgate
22rules establishing a drug testing program for probationers and parolees and persons
23on community supervision. The rules shall provide for assessment of fees upon

1probationers and parolees and persons on community supervision to partially offset
2the costs of the program.

AB150-ASA1-AA26,330,84 301.03 (3r) If any restitution ordered under s. 973.20 (1) remains unpaid at the
5time that a person's probation, community supervision or sentence expires, or he or
6she is discharged by the department, give to the person upon release, or send to the
7person at his or her last-known address, written notification that a civil judgment
8may be issued against the person for the unpaid restitution.".

AB150-ASA1-AA26,330,1911 301.08 (1) (b) 1. Contract with public, private or voluntary agencies for the
12purchase of goods, care and services for persons committed or sentenced to a state
13correctional or penal institution, placed on probation or community supervision to
14the department by a court of record, or released from a state correctional or penal
15institution. Services shall include, but are not limited to, diagnostic services,
16evaluation, treatment, counseling, referral and information, day care, inpatient
17hospitalization, transportation, recreation, special education, vocational training,
18work adjustment, sheltered employment, special living arrangements and legal and
19protective services.".

1301.32 (3) (a) All money or other property paid or delivered to a probation and
2parole agent or other employe of the department by or for the benefit of any person
3on probation, community supervision or parole shall be immediately transmitted to
4the department and it shall enter the same upon its books to his or her credit. The
5property shall be used only under the direction of the department.

AB150-ASA1-AA26,331,107 301.32 (3) (b) If the person on probation, community supervision or parole
8absconds, the money shall be credited to the revolving fund created by s. 304.075; and
9other property if not called for within one year shall be sold by the department and
10the proceeds shall be credited to the fund.".

AB150-ASA1-AA26,331,1313 301.35 (2) (am) A person on community supervision.".

AB150-ASA1-AA26,331,24 16302.14 (title) Property of deceased inmates, parolees or, probationers
17or persons on community supervision, disposition. When an inmate of a
18prison or a parolee of an institution or a person on probation or community
19supervision to the department dies leaving an estate of $150 or less in the trust of
20the warden, superintendent or secretary, the warden, superintendent or secretary
21shall try to determine whether or not the estate is to be probated. If probate
22proceedings are not commenced within 90 days, the warden, superintendent or
23secretary shall turn over the money or securities to the nearest of kin as evidenced
24by the records of the institution and the department.".

AB150-ASA1-AA26,332,16 5304.075 (title) Probationer and parolee loan Loan fund for persons on
6probation, community supervision or parole. The department shall create a
7revolving fund out of any moneys in its hands belonging to probationers and parolees
8and persons on community supervision who absconded, or whose whereabouts are
9unknown. The fund shall be used to defray the expenses of clothing, transportation,
10maintenance and other necessities for probationers and parolees and persons on
11community supervision who are without means to secure those necessities. All
12payments made from the fund shall be repaid by probationers or parolees and
13persons on community supervision for whose benefit they are made whenever
14possible; and any moneys belonging to them so paid into the revolving fund shall be
15repaid to them in accordance with law, in case a claim therefor is filed with the
16department upon showing the legal right of the claimant to such money.".

AB150-ASA1-AA26,332,2319 340.01 (7m) "Commercial driver license" means a license issued to a person by
20this state or another jurisdiction which is in accordance with the requirements of the
21federal commercial motor vehicle safety act of 1986, 49 USC 2701 to 2716 31301 to
2231317, and which authorizes the licensee to operate certain commercial motor
23vehicles.
